By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Definitions

Buyer: Refers to the purchaser of the Goods or any individual acting on behalf of and with the explicit authority of the Buyer.

Goods: Includes the products and, where applicable, the services specified in the document.

Price: Refers to the sale price of the Goods as agreed upon between the Seller and the Buyer, subject to clause 4.

Seller: AAA Sheds (All About Agricultural Sheds), which is the entity selling the Goods.

Services: Refers to all services provided by the Seller to the Buyer, including any advice or recommendations.

Legal Protections: These terms do not exclude, restrict, or modify any condition, warranty, guarantee, right, or remedy implied by law (including the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified.

General

These terms and conditions, which can only be waived through written consent signed by the Seller, prevail over any inconsistent terms in the Buyer’s order.

Terms of sale

(a) All Goods and other products sold by the Seller are subject to these terms and conditions.

(b) Instructions received by the Seller for the supply of Goods or Services from the Buyer constitute acceptance of these terms.

(c) Acceptance cannot be revoked without the Seller’s written consent. If revoked, the Buyer is liable for any incurred expenses, including labor, materials, and freight.

(d) No representative of the Seller is authorized to make any agreements or representations not in writing.

Seller's quotations

Unless previously withdrawn, quotations are valid for acceptance within the stated period or, if unstated, for seven (7) days from the date of issue. The Seller may refuse any order based on a quotation within seven days of receiving it.

Packing

The Buyer is responsible for any special packing costs, regardless of whether they are included in the initial quotation.

Shortage

Claims for shortages must be made within seven days of receipt of Goods, or they are waived.

Drawings and Specifications

(a) Specifications, drawings, and measurements provided are approximate and deviations do not void the contract.

(b) Catalogues and advertisements are not binding parts of the contract.

Performance

(a) Performance figures are estimates unless specifically guaranteed in writing.

(b) Estimates based on Buyer-provided plans are indicative and non-binding.

(d) Descriptions are indicative and do not guarantee fitness for any specific purpose unless expressly stated.

(e) The Buyer must specify intended use in writing to ensure suitability; otherwise, the Buyer cannot claim reliance on the Seller.

(f) The Buyer must follow assembly and safety instructions. Failure to comply absolves the Seller of liability.

Delivery

(a) Delivery rates are based on postcode. Buyers must confirm rates at checkout or contact the Seller for a quote.

(b) Products are available for collection at designated locations. Buyers will be notified for pickup.

(d) Buyers must provide suitable transportation for collected items.

(e) Delivery times are estimates; the Seller is not liable for delays.

(f) Delivery delays do not absolve the Buyer from payment obligations.

(g) Partial deliveries do not void the contract.

(h) Assistance for unloading must be provided; delivery is limited to ground level.

(i) Goods require careful handling due to their weight.

(j) The Seller is not liable for injuries or damages during delivery or assembly.

(k) Specific delivery timing requests may incur additional fees or result in “Authority to Leave” (ATL) designation.

(l) Missed deliveries may incur redelivery costs.

(m) ATL agreements transfer liability for any loss or damage to the Buyer.

Damaged, Incorrect, or Missing Parts

(a) Proof of Delivery (PoD) must include details of the delivery as evidence.

(b) Damaged or faulty Goods claims must be made within eight hours.

(d) Goods are deemed accepted unless claims are made within five business days.

Returns and Cancellation

(a) The Seller is not obligated to accept returns unless agreed in writing.

(b) Accepted returns must be sent to the Seller’s designated location.

(d) Refunds are discretionary and may include a 30% restocking fee.

(e) Cancellations require Seller consent and may incur indemnity charges.

(f) Cancellation charges are at least 30% of the order value.

Guarantee

(a) Seller-manufactured Goods are guaranteed against defects for 12 months under specified conditions.

(b) Non-Seller Goods are subject to manufacturer warranties.

Consumer guarantees

(a) AAA Sheds Warranty Terms are incorporated by reference.

(b) Implied warranties not explicitly stated are excluded to the extent permitted by law.

Prices

(a) Errors in pricing may result in order cancellation.

(b) Prices are exclusive of GST unless stated otherwise.

(d) Quotations are valid for 30 days unless otherwise agreed.

Payment

(a) Payment is due before dispatch unless otherwise agreed.

(b) Late payments incur interest as per the Uniform Civil Procedure Rules 2005.

Rights in Relation to Goods

(a) Ownership remains with the Seller until payment is made in full.

(b) Buyers cannot create liens or third-party claims on Goods before ownership transfer.

Storage

The Seller is not liable for storage of undelivered items. Storage fees may apply for delays caused by the Buyer.

Miscellaneous

(a) These terms are governed by New South Wales law.

(b) Invalid clauses do not affect the validity of the remaining terms.
